Terms and conditions of sale
1 – General information
The purpose of these general terms and conditions of sale is to govern the contractual relations between the company Digistore (RCS Strasbourg 451974125), whose registered office is located at 11 rue Jacobi Netter 67200 STRASBOURG FRANCE, and the Customer defined below as the user of the site and accepting these general terms and conditions of sale.
All other conditions are binding on Digistore only after written confirmation from it. The information on this site is provided for informational purposes only and may be modified by Digistore without prior notice. The mere act of placing an order on the site constitutes unreserved acceptance of these general terms and conditions of sale.
2 – Products
The characteristics of the products offered for sale are presented on the site in the product sheets.
Photographs in situ with other equipment and accessories are not contractually binding. The appearance of a product may have changed without the manufacturer updating the photos. It is also advisable to check the accessories provided in the description or specifications, as visuals in situ may be shown to show the use of a product in a complete configuration.
3 – Validity of sales offers and availability
Products are offered for sale while stocks last. For products not in stock in our warehouses, our offers are subject to availability from our suppliers and pricing conditions, which have not changed.
For items not in stock, an availability time is announced subject to stock availability at the manufacturer or supplier. In the event of a supplier shortage, we endeavor to obtain a delivery time or estimate, which is communicated to the customer by email as soon as possible.
4 – Product prices
The prices appearing on this site are expressed in Euro and are inclusive of all taxes (TTC) for the French version and exclusive of taxes (HT) for foreign versions, excluding shipping costs (except for the mention of free delivery valid in mainland France and Monaco). Prices may be displayed in foreign currencies listed in the drop-down list at the top right of the site, for information purposes only, as currency rates change rapidly, although they are in principle updated once a day (subject to availability of information servers), in all cases the conclusion of the order and payment are made in Euro.
Prices are subject to change at any time without notice.
To these prices, it is necessary to add the transport costs unless otherwise stated, calculated according to the type of items ordered and the carrier selected by the customer. The transport costs are specified at the bottom of the shopping cart and on the page for choosing the delivery method, it is finally recalled in the summary of the order which precedes the validation.
The price is payable in cash on the day of the order. The prices charged are those applied at the time of the order, subject to availability and typographical errors or changes in the French VAT rate. Any change in this rate will then be immediately reflected in the sales prices.
French VAT is not due for delivery addresses outside Europe or for companies in the European Union having provided the intra-community VAT number when creating the customer account, the validity of this number is checked immediately.
Outside the European Union or in the French overseas departments and territories, and depending on the legislation in force in the country of delivery, customs fees, duties and taxes may be claimed by the local authorities from the customer and are the responsibility of the latter.
5 – Order and invoicing
If the customer wishes to place an order, they must first identify themselves. To this end, they will complete, according to the instructions provided online, a form made available to them where they will include the information necessary for their identification, including their first name, last name, telephone number, postal address and delivery address. Additional information may be requested subsequently to ensure the quality and security of the delivery.
The customer, having chosen the products presented, will definitively validate his order by clicking on the “Validate order” button to demonstrate his commitment and acceptance of the General Conditions of Sale. From this moment, the order is registered, and an order number is communicated to the customer as well as a confirmation on the screen and by email. The data recorded by Digistore constitutes proof of the nature, content and date of the order.
As for special orders, the products of which have been specially ordered for the customer, they cannot be cancelled if the products have already been shipped by the suppliers in question and cancellation is no longer possible.
A detailed invoice with the amount of VAT calculated on the total excluding VAT and included in the total including VAT is sent to the customer by email or in their customer area, it can also be attached to the package.
The indication of the amount of VAT gives communities, companies and liberal professions the possibility of recovering it.
6 – Method of payment
The online store offers a wide selection of payment methods to meet the needs of its large customer base.
By bank card (Carte Bleue, Visa, Eurocard, Mastercard)
Validation of the order by credit card constitutes a mandate to pay the price of the order, including all taxes.
The customer is connected to the secure terminal of Société Générale, thanks to an encrypted connection (SSL protocol), the customer can securely transmit their bank card details directly to the bank's secure payment terminal without Digistore having any knowledge of them.
Our site supports the 3D SECURE strong cardholder authentication system (Verified by VISA, Mastercard Securecode) which requests additional information from the cardholder customer after entering the card information. If this authentication fails, Digistore reserves the right to refuse payment and cancel the order.
Digistore also reserves the right to request proof of identity and proof of address for any first order placed on the site.
By bank transfer
When choosing a bank transfer, the IBAN parameters are specified and recalled in the order confirmation.
The customer then has 7 days to make a transfer in payment of the total amount including tax of the order (shipping costs included) or the order will be automatically cancelled.
The order number must be specified as the reference for the transfer.
When a transfer is made from abroad, all costs must be borne by the sender.
By Paypal / American Express
The customer can identify himself and pay with his Paypal account or directly by card, notably with American Express.

This service is only offered to individual customers residing in France and Belgium for orders up to 6,000 Euros including tax.
In cash, only for on-site collection in our store in Strasbourg
Cash orders are not accepted.
7 – Digipoints loyalty points
It is possible to earn Digipoints loyalty points on the relevant products when this is specified on a product sheet. These points will be added to the Digipoints balance of the customer account when a relevant order is shipped. They can then be used to deduct part or all of the amount of a subsequent order. The points balance cannot be refunded.
8 – Late payment
If the customer is a professional: pursuant to Article L. 441-6 of the French Commercial Code, late payment penalties are payable on the day following the payment date shown on the invoice in cases where the amounts due are paid after this date. The rate of these penalties is three times the legal interest rate.
9 – Delivery method
Delivery will be made to the address specified by the customer when placing their order. It will be carried out by La Poste, UPS, or another carrier. Delivery will only take place once the order has been validated by the customer and payment has been made in full.
Any bank payment centers involved will have given their prior agreement to the payment. If the said centers refuse, the order will be automatically canceled.
Furthermore, Digistore reserves the right to refuse any order from a customer with whom there is an ongoing dispute.
10 – Delivery time
If the ordered item is available in stock, the shipping time is a maximum of 2 working days (Monday to Friday). For items that are not in stock, the supply time is announced on each product sheet. This time, which depends on availability from manufacturers and suppliers, is announced for information purposes only. This period starts from the effective payment of an order (immediate for instant payments (e.g.: bank card) except in cases of force majeure or exceptional events delaying or prohibiting the delivery of the goods.
In any case, delivery on time can only take place if the customer is up to date with his obligations towards the company.
Upon receipt of a damaged package with a missing or damaged product, the customer must specify their reservations on the delivery slip and confirm them, within two days of delivery, by email to Customer Service and by registered letter with acknowledgment of receipt addressed to the carrier.
11 – Verification of the order upon receipt
By signing the delivery slip, the customer accepts the delivered products as is and therefore no claims relating to damage incurred during transport will be accepted. It is the customer's responsibility to carry out all checks and make all reservations upon arrival of the equipment and to exercise, if necessary, all recourse against the carrier.
Upon receipt of the goods, the customer must immediately check their condition and conformity with the order. Any complaints relating to a defect in the delivered goods, an inaccuracy in the quantities or an incorrect reference compared to the Digistore order confirmation, must be made by email to Digistore Customer Service within seven days, failing which the right to make a complaint will cease to be acquired.
All returns must be made through the returns system via the customer area (My Account > My Returns) with the RMA return number specified on the package. Without a return number, any returned goods will be held at the customer's expense and risk, with all transport, storage, and handling costs being the customer's responsibility. In all cases, the return of goods is at the customer's expense and risk.
12 – Warranty and after-sales service
All products sold on the site are guaranteed against manufacturing and material defects. All our products benefit from the manufacturer's warranty, at least two years for parts and labor. In the event of a breakdown during the initial warranty period, repairs will be carried out free of charge by the national network of centers, stations, or technical agencies approved by the manufacturers. To benefit from the product warranty, it is essential to keep the product purchase invoice.
This warranty does not cover damage resulting from accidents, misuse, or negligence. Software malfunctions resulting from misuse are not covered by this warranty, nor is mishandling of computer boards (due to electrostatic shock).
In the event of the return of equipment that proves not to be defective, a handling and diagnostic fee of €30 including tax, including return transport costs, will be invoiced to the customer.
Any return of goods requires Digistore's prior agreement and the obtaining of a return authorization number (RMA), which must be legibly written on any returned package. The return of goods is carried out at the customer's expense, risk, and peril. Products returned by carrier without physical protection or poorly protected will not be eligible for the warranty; it is therefore the customer's responsibility to ensure that the returned product(s) are protected and insured for transport.
It is the customer's responsibility to keep all packaging and accessories supplied with the product as well as any labels affixed to the product or its packaging, which are necessary to benefit from the guarantee offered.
Digistore is not the producer of the products presented, within the meaning of Law No. 98-389 of May 19, 1998 relating to liability for defective products. Consequently, in the event of damage caused to a person or property by a product defect, only the liability of the producer of the product may be sought by the customer.
Digistore will ensure that the warranty is applied to any returned product as quickly as possible. However, when the repair requires returning the product to the manufacturer, it cannot be held responsible for any delays caused by the manufacturer. Furthermore, Digistore's after-sales service will select the carrier responsible for delivering the goods to the customer.
Due to the way LCD screens are manufactured, pixel defects are often unavoidable. They only constitute manufacturing defects if they deviate from the specifications and tolerances announced by the manufacturer.
13 – Right of withdrawal
From the date of delivery of your order, if you are an individual, you have 14 days from the date of receipt of your package to exercise your right of withdrawal and be reimbursed for the total amount (excluding return costs). Once the agreement has been received by email with the return number, the product concerned must be returned to us within 14 calendar days following receipt of this agreement (postmark or shipping date appearing on the slip being proof) otherwise the return will no longer be accepted.
It is the customer's responsibility to over-pack the original packaging of this/these product(s) (do not send it as is by writing on it or sticking the shipping slip directly on it), because only products returned in their entirety (accessories, manuals, covers, CDs, etc.) and in their original packaging will be accepted, everything must be intact and in perfect condition for resale.
Any product that has been damaged, incomplete, soiled or whose original packaging has been damaged may be subject to a discount.
This right of withdrawal does not apply:
- to software, as soon as the packaging is opened (unsealed) or the seal on the CD/DVD sleeve is broken.
- to computer cards when they have been handled outside their protective sleeve (risk of defect following electrostatic shock) and the seal is broken.
- to external video or audio interfaces for computers supplied with a card/adapter and/or software removed from its sleeve (which may have been used and activated).
- to video projectors with a lamp usage time of more than 1 hour (based on video projector usage statistics).
- to tailor-made / personalized products for the customer.
This right of withdrawal is exercised without penalty, with the exception of return costs which remain the responsibility of the consumer. In the event of exercising the right of withdrawal, the consumer has the choice of requesting either a refund of the sums paid, or an exchange of an amount equivalent to the sums paid or, where applicable, with a bank supplement, the re-shipping costs remaining the responsibility of the consumer.
Digistore cannot under any circumstances be held liable for compensation following the impossibility of using the purchased product due to incompatibility with the hardware or software already owned by the customer; it is the customer's responsibility to check compatibility at the time of ordering.
In the event of exercising the right of withdrawal, Digistore will do its utmost to reimburse the consumer within 15 days.
The consumer will then be reimbursed by re-crediting their bank card in the event of payment with it or by bank transfer in other cases.
14 – Reservation of ownership and liability
Digistore retains ownership of the goods until full payment is received from the customer. The transfer of ownership of the products to the customer occurs upon full payment of the price. However, during the period between delivery and transfer of ownership, the risks of loss, theft, or destruction are the responsibility of the customer.
Failure by the customer to fulfill its payment obligations, for any reason whatsoever, gives Digistore the right to demand the immediate return of the delivered goods at the customer's expense, risk and peril. The customer undertakes, in the event of receivership proceedings affecting its Company, to actively participate in the establishment of an inventory of the goods in its stocks and of which Digistore claims ownership. Failing this, Digistore has the right to have the inventory recorded by a bailiff at the customer's expense. The customer is prohibited from reselling, transforming or incorporating the delivered goods from the date of the judgment ordering receivership or liquidation of the assets of its Company. Digistore may prohibit the customer from reselling, transforming or incorporating the goods in the event of late payment.
To guarantee payments not yet made and in particular the balance of the customer's account in the accounts of Digistore, it is expressly stipulated that the rights relating to goods delivered but unpaid will be carried over to identical goods from Digistore in stock at the customer's premises, without it being necessary to allocate payments to a specific sale or delivery.
15 – Data confidentiality
Personal data provided by the customer is not distributed to third parties.
In accordance with Law 78-17 of January 6, 1978, the customer has the right to access and rectify their personal data at any time. To exercise this right, simply contact Digistore Customer Service.
16 – Attribution of jurisdiction
The products offered for sale comply with French and European regulations. If applicable, it is the responsibility of the foreign customer to check with local authorities the possibilities of using the product they plan to order. Digistore cannot be held liable in the event of non-compliance with the regulations of a foreign country.
For professional clients, all disputes relating to the formation, execution and termination of contractual obligations between the parties which cannot give rise to an amicable settlement will be submitted to the jurisdiction of the Commercial Court of Strasbourg, France, in the district where the headquarters of Digistore is located.
The original language of these conditions of sale is French. In the event of a dispute, only the French text will be taken into account.
